MEMBERSHIP TERMS AND CONDITIONS

Introduction

1.1 These terms and conditions apply to all Membership plans offered by The Dental House (Liverpool) Limited.

1.2 Membership is a scheme to provide preventative dental treatment over a twelve-month period and to provide additional discounts and/or benefits to individuals who are registered under the scheme (“Members”) as stated under “Benefits” below. To become a Member, you must have completed a full Oral Health Examination at the practice within the last six-months and completed any necessary treatment. Do not proceed to sign-up payment if this is not the case or you have previously been suspended by the practice.

1.3 You can access the current version of these Terms and Conditions from a member of our Customer Service Team or our website at www.dentalhouseliverpool.co.uk/membership .

1.4 All services delivered by The Dental House (Liverpool) Limited, including Membership, are delivered in accordance with our “Terms of Business”, available at our website at www.dentalhouseliverpool.co.uk/membership .

Commencement, Duration and Cooling Off Period

2.1 By entering into a Membership plan, Members are committing to a “Minimum Membership Period” of twelve (12) months at a time, subject to the “Cooling Off Period” (per clause 2.3).

2.2 Members are entitled to the benefits of the Membership plan from the date their application is accepted by The Dental House (Liverpool) Limited  (the “Commencement Date”) until the plan is terminated by either party. (If the practice suspends a Member, this is also classed as the end of the Membership. This would be issued in writing to the Member.)

2.3 Members have a fourteen (14) day Cooling Off Period from the date they complete their Membership application form in which to cancel their Membership. If a Member cancels their Membership within this period any payment they have made towards Membership will be refunded in full, provided they have not accessed any benefits available under Membership. If benefits have been accessed, these would be charged to the Member at the standard private fee per item. Following the fourteen (14) day Cooling Off Period, if a Member cancels or fails to make payment within the Minimum Membership Period of twelve (12) months, the Member would owe the practice the balance for the remainder of the 12-months membership fee.

2.4 Cancellation within the Cooling Off Period can be actioned by the Member emailing us at [email protected] or writing to us at Membership Services, The Dental House (Liverpool) Limited, 6-12 Derby Lane, Old Swan, Liverpool L13 3DL. You will then be contacted with instructions about how to cancel the membership.


2.5 All payments under Membership plans are non-refundable, save for the provisions of clause 2.3. 

2.6 It is the responsibility of Members to avail themselves of the benefits of Membership. The Dental House (Liverpool) Limited, shall not accept any responsibility, nor offer any refunds, for a Member’s failure to access the benefits available to them over the 12-month periods. Benefits do not carry forward beyond the 12-month period.

2.7 Appointments offered as a benefit of Membership are subject to our cancellation policy, per our Terms of Business. Accordingly, a Member may lose one or more appointments where they cancel at short notice or fail to attend. (“Late Notice Cancellation” – Defined as contact received by the practice via phone/email to cancel with less than 24 hours but greater than 4 hours before the appointment start time. If less than 4 working hours’ notice then it will class as a “Failure to Attend”. If you Fail to Attend a treatment appointment it will be charged at £1 per minute rate. If it was a missed appointment from your annual benefits allocation (e.g. Hygiene), then it is lost and you would need to pay if you wanted to reinstate. This fee would be at the normal private appointment fee less the appropriate membership discount. Note, additional Oral Health Examinations are not discounted for members.

Renewals and Alterations

3.1 Following the Minimum Membership Period of twelve (12) months, Membership shall renew automatically on each anniversary of the Commencement Date (the “Renewal Date”).

3.2 The Dental House (Liverpool) Limited, will not issue revised documentation or remind a Member of renewal except where there is a variation to the plan’s pricing, terms and conditions or benefits. 

3.3 After the Minimum Membership Period, one (1) month’s notice in writing prior to the renewal date is required to terminate Membership. Notice can be provided by e-mailing [email protected] or writing to us at Membership Services, The Dental House (Liverpool) Limited, 6-12 Derby Lane, Old Swan, Liverpool L13 3DL. Valid notice must include the Member’s full name and their date of birth. In the case of Child Members, notice will be accepted from the registered parent or guardian.

If a member leaves the plan before that 12-months is completed (following the Minimum Membership Period of twelve (12) months):

– If less than 2-months into the new 12-month period the Member would owe any discounted treatment amount back to the practice over that partial membership term. 

– If greater than or equal to 2-months into the membership period after the Minimum Membership Period of twelve (12) months, the Member would owe the balance for the remainder of the 12-months membership fee. (The membership is a 12-month at a time financial agreement between the Member and the practice.)



3.4 The Dental House (Liverpool) Limited reserves the right to vary or make changes to Membership, these terms and conditions, and the benefits available after giving 30 days’ notice of any such change.

Transferability of Plan Benefits

4.1 Membership is restricted to The Dental House (Liverpool) Limited, as specified on a Membership application. Membership benefits are not transferrable. 

Notices

5.1 All notices under these Terms and Conditions shall be issued by email to the registered e-mail address for the Member, or if no e-mail address is provided in writing to the last known address.

Third Party Rights

6.1 A person who is not a party to this contract has no rights under the Contracts (Right of Third Parties) Act 1999 to enforce any of these terms and conditions or the provisions of the Policy Document.

Governing Law

7.1 These Terms and Conditions and the policy document shall be governed by and construed in accordance with the laws of England and will be subject to the exclusive jurisdiction of the English Courts.
